Terms of Service & End-User License Agreement

1. Agreement to These Terms

These Terms of Service and End-User License Agreement (the "Terms") form a binding contract between you and Momatan Studios ("we", "us", "our") and govern your use of Apoca LE and any related services (collectively, the "Game"). By signing in to or playing the Game, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Game.

You must be at least 13 years of age (or the age of digital consent in your country, whichever is higher) to play. By using the Game you represent that you meet this requirement.

2. License Grant

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Game on devices you own or control, solely for your personal, non-commercial entertainment. You may not copy, modify, reverse-engineer, decompile, disassemble, sell, lease, sublicense, or create derivative works of the Game except to the extent these restrictions are prohibited by law.

3. Your Account

• You authenticate using Sign in with Apple. You are responsible for safeguarding your Apple ID and any device on which you remain signed in.
• You may not share, sell, transfer, or commercialize your account.
• You must provide accurate information when prompted, and you must keep your contact information current.
• One person, one account. We may close duplicate accounts.
• You may delete your account at any time from inside the app (Profile → Delete Account). Deletion is permanent.

4. Acceptable Use & Player Conduct

You agree not to, and not to attempt to:

• Cheat, exploit bugs, use bots, location spoofing, modified clients, GPS emulators, or any tool that gives an unfair advantage.
• Harass, threaten, defame, or stalk any player, or engage in hate speech or other abusive behavior.
• Submit display names, ship names, or other content that is sexually explicit, violent, hateful, defamatory, infringing, deceptive, or otherwise objectionable.
• Trespass, drive distractedly, or otherwise endanger yourself or others while playing.
• Disrupt, overload, probe, or attempt to gain unauthorized access to our servers, infrastructure, or other players' accounts.
• Use the Game for any commercial purpose, advertising, or solicitation.
• Violate any applicable law or third-party right.

5. User-Generated Content

You are solely responsible for any content you submit to the Game, including pilot display names, ship nicknames, and any text you provide in reports or other in-game fields ("User Content"). You represent that you own or have the necessary rights to your User Content and that it does not violate these Terms.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, display, and use your User Content solely for the purposes of operating and improving the Game and enforcing these Terms. We may remove or modify any User Content at any time, with or without notice, if we believe it violates these Terms or harms players.

6. Virtual Currency & In-App Purchases

• Elite Coins are a non-renewing consumable virtual currency. They have no monetary value, cannot be redeemed for cash, and cannot be transferred to another account or person.
• All purchases are final and non-refundable except where required by law or by Apple's refund policy. Refund requests should be submitted to Apple.
• We may at our discretion add, remove, change, or rebalance virtual items, prices, and game features. Such changes will not entitle you to a refund of previously consumed virtual items.
• Any unused Elite Coins may be forfeited if your account is terminated for breach of these Terms or if the Game is permanently discontinued.
• You may use the in-app "Restore Purchases" button to re-grant any previously completed purchase that did not credit due to a network or verification error.

7. Location-Based Play & Safety

Play it safe. Your safety is more important than the Game.

• Be aware of your surroundings at all times. Do not play while driving, operating heavy machinery, or in any situation that requires your full attention.
• Obey all applicable laws, traffic signals, and posted signs. Do not trespass on private property, restricted areas, or anywhere you do not have permission to be.
• The Game uses real-world coordinates from your device. Map data and GPS readings can be inaccurate. Do not rely on the Game for navigation or safety.
• You play at your own risk. We are not responsible for any injury, property damage, or other loss that occurs while you are playing.

8. Enforcement, Reporting & Blocking

You can report abusive players or content from inside the Game, and you can block other players to prevent interaction with them. We review reports and take action we consider appropriate, which may include warnings, content removal, temporary suspension, or permanent termination of an account. We are not obligated to act on every report and we are not liable for actions taken by, or content posted by, other players.

9. Intellectual Property

The Game, including all software, art, audio, text, designs, faction lore, ship classes, and trademarks, is owned by Momatan Studios or its licensors and is protected by intellectual property laws. Except for the limited license granted in Section 2, you receive no rights in the Game.

10. Disclaimers

The Game is provided "as is" and "as available" without warranties of any kind.

To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. Some jurisdictions do not allow the exclusion of certain warranties; the disclaimers above apply only to the extent permitted by your local law.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Game is limited to the greater of (a) the amount you paid us in the 90 days before the claim arose, or (b) USD $25.

12. Indemnification

You agree to defend, indemnify, and hold harmless Momatan Studios and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Game, your User Content, or your violation of these Terms or any law or third-party right.

13. Termination

We may suspend or terminate your access to the Game at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Game. You may stop using the Game and delete your account at any time. Sections that by their nature should survive termination (including Sections 5, 6, 9, 10, 11, 12, 15) will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app and you will be asked to accept the updated Terms before continuing to play. Continued use after the effective date constitutes acceptance.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. You and Momatan Studios agree that any dispute arising out of or relating to these Terms or the Game will be resolved exclusively in the state or federal courts located in Delaware, except where prohibited by your local law and except for small-claims actions you may bring in your local jurisdiction.

Class-action waiver. To the extent permitted by law, disputes will be brought only in your individual capacity, not as a plaintiff or class member in any class or representative action.

16. Apple-Specific Terms

If you downloaded the Game from the Apple App Store, the following additional terms apply:

• These Terms are between you and Momatan Studios. Apple is not a party to these Terms and is not responsible for the Game or its content.
• The license granted in Section 2 is limited to using the Game on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
• We are responsible for addressing any product or warranty claims, including product liability, statutory consumer-protection claims, and intellectual-property-infringement claims, except as limited by Section 11.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
